Welcome to the Employee Performance Scores ("EPScores") platform. By accessing or using our website, services, or tools, you agree to be bound by these Terms and Conditions ("Agreement"). Please read this Agreement carefully.
1. Acceptance of Terms
By creating an account or using the EPScores platform, you agree to comply with and be legally bound by this Agreement and our Privacy and Confidentiality Agreement.
2. Description of Service
EPScores is a membership-based platform that enables employers to submit performance reviews for current or former employees. These reviews are used to calculate EPScores, which may be visible to other employers and employees, as described in our Privacy Policy.
3. Eligibility and Account Responsibility
You must be at least 18 years old and legally capable of entering into binding agreements to use this platform. You are responsible for maintaining the confidentiality of your account login information and for all activities that occur under your account.
4. User Conduct
You agree to use the EPScores platform only for lawful purposes. You may not:
• Submit false or misleading information• Harass or abuse other users• Impersonate another person• Create multiple accounts for fraudulent purposes• Use the platform to promote illegal or unethical hiring practices• Interfere with the platform's operation
5. Performance Review Guidelines
Employers must ensure all performance reviews are accurate, honest, and based on documented performance. Reviews must not contain discriminatory, defamatory, or retaliatory content. EPScores reserves the right to remove any review that violates these standards.
6. Fees and Billing
Some features of EPScores may require payment. All fees are non-refundable unless otherwise stated. You agree to pay all applicable fees as described at the time of purchase.
7. Data Ownership and Usage
While you maintain rights to your personal information, all data submitted, including performance reviews and EPScores, becomes part of the EPScores platform. EPScores retains the right to use and display this data in accordance with our Privacy Policy.
8. Intellectual Property
All content on the EPScores platform, including but not limited to text, logos, designs, software, and databases, is the property of EPScores and protected by intellectual property laws. You may not copy, reproduce, or distribute any content without written permission.
9. Termination of Access
EPScores reserves the right to suspend or terminate your access to the platform at any time, for any reason, including violation of this Agreement or misuse of the platform.
10. Disclaimers and Limitation of Liability
EPScores provides the platform "as is" without warranties of any kind. We do not guarantee employment outcomes, the accuracy of reviews, or uninterrupted access. To the fullest extent permitted by law, EPScores is not liable for any damages resulting from your use of the platform.
11. Indemnification
You agree to indemnify and hold harmless EPScores, its affiliates, and its personnel from any claims, liabilities, damages, or expenses arising out of your use of the platform or violation of this Agreement.
12. Modifications to Terms
EPScores may modify this Agreement at any time. We will provide notice of changes by updating the "Effective Date." Continued use after changes constitutes acceptance of the revised terms.
13. Governing Law
This Agreement is governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising from this Agreement shall be resolved in the appropriate courts of Florida.
14. Honest Review Protection
We support the right to post honest reviews. In accordance with the Consumer Review Fairness Act (CRFA), EPScores does not penalize or prohibit users from posting truthful reviews about employers or experiences.
15. Job Posting Compliance
Employers must ensure all job listings comply with federal, state, and local anti-discrimination laws. EPScores prohibits discriminatory job ads and reserves the right to remove or reject any posting that violates applicable law.
16. Communications and CAN-SPAM Compliance
If you receive communications from EPScores, you can opt out at any time by following the unsubscribe instructions or contacting support. We comply with all applicable email marketing laws.
